TERMS OF USE AND PRIVACY POLICY AGREEMENT

Welcome to Certified Mail Labels and Send Certified Mail websites (the “Sites”), which are websites, trademarks, and business names owned and operated by Certified Mail Envelopes, Inc., a Florida Corporation. Any information or transactions you provide to us are subject to our Terms of Use and Privacy Policy described below. You may have transitioned to this site from Google, Yahoo, Bing, or the United States Postal Service and other third-party websites, and any information you provided while on that site will be governed by their privacy policy. Our End User Agreement (the “Agreement”) between you and our websites governs access and services provided by this website and our parent company Certified Mail Envelopes, Inc. a Florida Corporation (this Agreement uses the terms “Certified Mail Labels” “Send Certified Mail” “Certified Mail Envelopes” and “the Site” interchangeably and the use of one term shall be considered to encompass the other as well). By establishing an account with a username and password, you agree, on your behalf and on behalf of any entity which you represent, to accept and be bound by the terms and conditions of this Agreement. Your use of the Site and any purchase of products or services, now or in the future, indicate your continued acceptance of our Terms of Use and Privacy Policy Agreement. You agree that the electronic acceptance of this Agreement is intended to have the same force and effect as if this Agreement were physically signed. In addition, when using our services, you are subject to the guidelines and rules applicable to the U.S. Postal Service (USPS) mail services and the Postal Inspection Service. All such guidelines and rules applicable to such services are hereby incorporated by reference in this Agreement.

DESCRIPTION OF SERVICES

The Sites have been designed and developed to meet the needs for addressing, tracking, and purchasing print mailing services and postage from the U.S. Postal Service, including sending USPS First Class, Certified Mail, Certificates of Mail, Priority Mail, and Priority Express Mail. It allows the purchase of USPS Certified Mail, Priority Mail, Priority Express, and First Class postage address labels to be addressed quickly and easily, without making a trip to the Post Office.

Agency Authorization

You hereby authorize our Sites to act as your agent for the purpose of preparing, sending, and receiving communications and documents using the following delivery methods: USPS Certified Mail, Return Receipt Electronic, Signature Confirmations, First-Class Mail, Priority Mail, Priority Express Mail, email notifications, fax, and SMS text messaging. This agency relationship is established to facilitate document delivery and receipt of communications on your behalf. You acknowledge that our role as an Agent includes printing, addressing, mailing, USPS acceptance, transmitting email, fax, and SMS text messaging, and receiving such communications as part of our services.

PRIVACY

Your privacy is very important to us. Our Privacy Policy is our commitment to safeguarding your privacy and governs the use of information collected from you or provided by you while on the Sites.

ELECTRONIC COMMUNICATIONS

When you visit the Sites or send e-mails to us, you are communicating with us electronically, and by doing so, you consent to receive related communications from us electronically. We will communicate with you by e-mail or by posting notices on this Site. We may amend this Agreement without advance notice to you by posting the changes on the Site. These changes will be effective when each user posts and accepts them upon logging in to use our systems. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement.

AI Telephone Agent Agreement

This Agreement grants the Sites the right to use Artificial Intelligence (“AI”) powered voice systems, automated telephone agents, virtual assistants, and related technologies to provide customer support and help 24/7 for inbound and outbound business communications.

AI TELEPHONE AGENTS AND COMMUNICATION SERVICES

The Sites utilize AI-powered telephone systems, automated voice agents, virtual assistants, machine learning technologies, speech recognition, speech synthesis, predictive dialing systems, and other automated communication technologies (collectively, “AI Communication Services”) to assist customers, users, vendors, employees, and other authorized parties. AI Communication Services may be used for customer service, technical support, onboarding, account management, compliance notifications, transaction confirmations, billing assistance, fraud prevention, quality assurance, scheduling, follow-up communications, marketing communications where legally permitted, and operational support.

CONSENT TO INBOUND AND OUTBOUND COMMUNICATIONS

By creating an account, using the Site, submitting a form, placing an order, communicating with us, or providing a telephone number, you expressly consent to receive telephone calls, prerecorded messages, artificial voice communications, SMS messages, and AI-assisted communications from our Sites and our company, its service providers, and authorized agents. Such communications may be made using automated telephone dialing systems (ATDS) or similar technologies to the maximum extent permitted by applicable law. You acknowledge that AI systems may answer inbound help and support questions or initiate outbound calls regarding your account, support requests, transaction activity, compliance mailings, reminders, account security, payment matters, service updates, or other business-related purposes.

CALL RECORDING AND MONITORING

You acknowledge and consent that inbound and outbound telephone calls, AI voice interactions, screen sharing sessions, chat sessions, and related communications may be monitored, recorded, transcribed, analyzed, summarized, stored, and reviewed by our Sites and its authorized service providers for quality assurance, training, legal compliance, fraud detection, dispute resolution, system improvement, regulatory compliance, and operational purposes. Such recordings and transcripts may be retained for business continuity, audit, evidentiary, or compliance purposes in accordance with our data retention policies and applicable law.

DISCLOSURE OF AI PARTICIPATION

The Sites may disclose at the beginning of a call or communication that the interaction may involve an AI-powered voice assistant or automated system. You understand and agree that AI systems may communicate in a human-like conversational manner. Your continued participation in the communication constitutes consent to proceed.

TEXT MESSAGING AND MULTI-CHANNEL COMMUNICATIONS

You authorize our Sites to communicate using SMS text messaging, MMS, email, voice calls, voicemail, AI-generated summaries, and other communication channels associated with your account or contact information. Message and data rates may apply. You are responsible for maintaining accurate and current contact information.

OPT-OUT RIGHTS

You may opt out of non-essential marketing communications at any time by following the instructions provided during the communication, contacting customer support, or updating your account preferences. Operational, transactional, compliance, fraud prevention, billing, and account-security communications may continue as necessary to provide services and fulfill legal or contractual obligations.

THIRD-PARTY SERVICE PROVIDERS

The Sites may use third-party vendors, telecommunications providers, AI platform providers, cloud hosting companies, customer relationship management systems, analytics providers, and related service providers to facilitate AI Communication Services. Such providers may process recordings, transcripts, metadata, and communication content solely for authorized business purposes, subject to contractual confidentiality and security obligations.

NO GUARANTEE OF ACCURACY

AI-generated responses, summaries, recommendations, and communications are provided for convenience purposes only and may contain inaccuracies, transcription errors, misunderstandings, delays, or omissions. Users remain responsible for independently verifying important information, legal notices, mailing details, compliance obligations, deadlines, and transaction accuracy before relying upon any AI-generated communication.

TCPA, STATE LAW, AND REGULATORY COMPLIANCE

The Sites intends to operate its AI Communication Services in compliance with the Telephone Consumer Protection Act (“TCPA”), the Telemarketing Sales Rule (“TSR”), applicable state privacy laws, call recording laws, and other applicable federal and state regulations. Users agree not to use the Site or services in any manner that would cause our Sites to violate applicable telecommunications or privacy laws.

LIMITATION OF LIABILITY FOR AI SERVICES

To the maximum extent permitted by law, Certified Mail Envelopes, Inc., and its Sites shall not be liable for damages arising from interruptions, inaccuracies, delays, failed connections, transcription errors, voice synthesis errors, automated decision-making, or other issues associated with AI Communication Services or telecommunications systems.

USER RESPONSIBILITY

Users are solely responsible for ensuring that any telephone numbers, email addresses, or contact information submitted to the Sites are accurate and that the user has authority or consent to provide such contact information for communication purposes. Users agree not to misuse AI Communication Services for unlawful, fraudulent, abusive, harassing, or unauthorized purposes.

DATA SECURITY

The Sites implement commercially reasonable administrative, technical, and physical safeguards designed to protect communication data, recordings, transcripts, and account information. However, no transmission or storage system can be guaranteed to be completely secure, and users acknowledge and accept such inherent risks.

Except as expressly modified herein, all other provisions of the existing Terms of Use and Privacy Policy shall remain in full force and effect.

USER ELIGIBILITY

This Sites are available only to persons over the age of 18 who can form a legally binding agreement(s) under applicable law. If you do not qualify, you are not permitted to use the Sites or order products or services from our company. We may refuse any or all of our services to anyone at any time, at our sole discretion.

LICENSE AND SITE ACCESS

Our Sites grants you a non-exclusive, non-sublicensable, revocable, non-transferable, limited right to license, to access the Sites and to create, print, and have placed in the United States Mail or with other delivery providers based upon the intended destination of such printed materials (“Printed Material”) by the terms of this Agreement. Any rights not expressly granted to you by this Agreement are reserved to our company.

PROPRIETARY RIGHTS

The Sites and any data used in connection with the Sites contain proprietary and confidential information that is protected by applicable intellectual property and other laws. Any and all intellectual property rights (“Intellectual Property”) associated with the Sites and their contents are the sole property of their respective owners. Certified Mail Envelopes, Inc., its affiliates, or third parties. The Site is protected by copyright and other laws in both the United States and other countries. In addition, the Sites are presented with a distinctive “look and feel,” and this “look and feel” is the proprietary property of Certified Mail Envelopes, Inc. All custom graphics, icons, and other items that appear on the Site are trademarks, service marks, or trade dress (“Marks”) of Certified Mail Envelopes, Inc., its affiliates, or other entities that have granted our Sites the right and license to use such Marks and may not be used or interfered with in any manner without the express written consent of each party including Certified Mail Envelopes, Inc. Except as otherwise expressly authorized by this Agreement, you may not use, copy, reproduce, modify, lease, loan, sell, reverse assemble, or otherwise attempt to discover any source code, create derivative works from, upload, transmit, or distribute the Intellectual Property of the Sites in any way without the appropriate third party’s prior written permission. Except as expressly provided herein, our Sites do not grant you any express or implied rights to Certified Mail Envelopes, Inc. or any third party’s Intellectual Property.

USE OF OUR SITE

Our Sites will not read or disclose to third parties private postal or electronic communications transmitted using our Sites' services, except as required to operate the service or as otherwise authorized by law.

ADDRESS INFORMATION

We consider your mailing information and documents to be private. All documents and list files you submit will be used solely for the production of your mailing(s) labels. Electronic information submitted by you is securely stored only for the time specified in our Terms of Service. After this time, the data is purged from our system.

YOUR CONTENT

All information, data, text, software, photographs, graphics, messages, or other materials (“Content”) you upload, post, or create using the Site is solely your responsibility. Our Sites will routinely retain the Original Content for at least 90 days and Mailed Archive Data for 10 years. We will use such Content only under this Agreement. You must evaluate and bear all risks associated with the use of any of your Content and the mailing of your Printed Material. We will not routinely screen or review text or graphics before printing and mailing Printed Material. We cannot, nor do we try to control, the content of Printed Material created on the Sites. You are solely responsible for and assume all liability arising from all Printed Material that you and any other person accessing our website using your User ID login and password to print and mail from the Sites. You represent and warrant to Certified Mail Envelopes, Inc. that: (i) you and your authorized users have the full right, power, and authority to perform any function with relation to the Content (including, without limitation, uploading, posting, reproducing, distributing, publicly displaying, and making derivative works from the Content) that you or they perform using our Sites and services.

YOUR INFORMATION

All information you provide to us about yourself during the registration process or through any other feature on the Sites will be referred to as “Your Information.” Our Sites will use Your Information only to provide the services available on our Sites. We act merely as a passive conduit for your online design, creation, printing, and mailing of your Content, in reliance on your representations and warranties in this Agreement. You authorize our Sites and its vendors and contractors to cooperate with the U.S. Postal Service, the Postal Inspection Service, and any U.S. or non-U.S. Law Enforcement or Governmental Agency, which cooperation includes but is not limited to, Certified Mail Envelopes, Inc. voluntarily disclosing (i.e., without being subject to a lawful order to disclose) any or all of Your Information and your content or transaction.

PAYMENT AND CREDIT

To use our Sites, you must provide payment through one of our approved payment sources, such as debit or bank card, credit card, eCheck, ACH, check, bank wire, money order, promotional voucher, or any other means available on our Sites. Accounts that pay by check, ACH, or electronic funds transfer earn a cash discount. If you are paying by credit card or purchasing services at a local Post Office, your rates may be slightly higher. We reserve the right to stop accepting debit or credit cards from one or more issuers at any time for any reason. Our Sites sells service credits that you (or an Administrator for your account) purchase in advance and allocate to your Sites account. We do not guarantee that you will be able to use your Sites service credits or account balance to purchase all products and services. Certain products and services may be non-refundable or fall outside our control, requiring prepayment (USPS Postage, Special Services, etc.).

REFUNDS: LABEL GENERATION

If you create a Postage Label online, USPS requires you to mail the item within 24 hours. Items not mailed must be canceled by using the Refund Postage link inside your account. Postage labels may be canceled if the label has not been activated by the U.S. Postal Service (USPS) and the transaction date is more than 14 days old. When you cancel a Certified Mail Label, the transaction information is submitted to the United States Postal Service for verification and approval of the refund. USPS determines if the postage refund is approved or declined. Postage refunds are typically approved in 20 business days after each label is canceled or refunded. The total cost of purchasing a Label is displayed before each transaction is processed. The cost includes USPS postage and electronic transaction fees. The transactional costs are non-refundable. Only the postage portion of the transaction that is not used will be refunded into your online account balance if approved by the U. S. Postal Service. This can include Priority Mail, Priority-Express, Certified Mail, Return Receipt Electronic, Restricted Delivery, and other postage services. First-Class Mail labels are non-refundable.

REFUNDS: FAILURE OF USPS TO DELIVER OR PERFORM SERVICES

Our sites have no control over the United States Postal Service (USPS) failing to properly deliver mail or provide proper delivery service. By logging into our website and completing a purchase transaction or uploading data for processing, you agree that we do not refund money for failure of any USPS services and all Terms of Use.

ENVELOPE RETURN POLICY:

Customers have 15 days after receipt of a shipment to notify us of any errors. Goods must be inspected by the customer upon receipt, and any claim of incorrect size or defective merchandise must be submitted via a support ticket to our Help and Support desk. No credit, refund, or exchange will be permitted after data processing, printing, or postage is applied to the envelopes or papers.

If the customer sends back an eligible-for-credit or damaged return, it is the customer’s responsibility to pay the freight for the return shipment.

Certified Mail Envelopes has a ‘No Questions Asked for: 30-day return Policy for unopened, undamaged, or unused envelopes, please ship the items with a copy of your order to Certified Mail Envelopes, Inc. Only full packages can be returned, no partial boxes or loose envelopes. Goods more than 30 days past the original ship date cannot be returned. Should the goods be received more than 30 days after the original ship date, for whatever reason, restocking charges will be applied to the credit.

Restocking Fees:

31-45 days: 30% Restocking Fee
46-60 days: 50% Restocking Fee
61+ days: No refunds can be accepted.

COMPLIANCE WITH LAWS

When you use the Site in any way, such as creating postage labels, printing, and mailing printed material, you will comply at all times with all applicable United States Federal, state, and local laws, statutes, regulations, rulings, and ordinances, and will not take any action that will harm or violate the rights of any person or entity. If you mail material outside the United States, you will comply with the laws of the country to which such material is mailed. Certified Mail Labels and the Site are based in the United States. The United States and certain other jurisdictions control the export of products and information. You agree to comply with all such applicable restrictions and not to export or re-export any information to countries or persons prohibited under the United States or other applicable export control laws or regulations.

INDEMNIFICATION

You will indemnify and hold the Sites and Certified Mail Envelopes, Inc. and its subsidiaries, affiliates, officers, shareholders, employees, agents, printers, contractors, vendors, co-branders, suppliers, internet service providers, and partners harmless from any loss, cost, claim, demand or other harm of any kind, including reasonable attorneys’ fees, due to or arising out of Your Information, your Content, or your Printed Material, your use of this Sites, and the use of this Site by any person while logged on under your username and password, your default under any provision in this Agreement, your violation of any laws and your violation of any rights of another person.

TERMINATION

The Sites, in its sole discretion, without notice to you, may: (1) terminate your access to the Site or your use of any feature of the Sites, (2) remove and discard any of Your Information and your Content stored on the Sites, or (3) refuse service and (4) terminate the Site, or any feature on the Site. We will not be liable to you or any third party for any suspension or termination of your access to the Sites or your Content.

DISCLAIMER OF WARRANTIES

Your use of the Sites is at your sole risk. These sites are provided on an “as is” and “as available” basis. We disclaim all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. The Sites makes no warranty that (1) the Sites will meet your requirements, (2) the Sites will be uninterrupted, timely, secure, or error-free, (3) the results that may be obtained from the use of the Sites will be accurate or reliable, (4) the quality of any products, services, information, or other material purchased or obtained by you through our Sites will meet your expectations, (5) that any materials will be received by an addressee, and (6) any errors in the website software will be corrected. Any material downloaded or otherwise obtained using the Sites is done at your discretion and risk, and you are solely responsible for any damage to your computer system or loss of data that results from the download of any such material. No advice or information, whether oral or written, obtained by you from the Sites or through or from the Site shall create any warranty not expressly stated in this user agreement.
